RENTAL TERMS AND CONDITIONS
TERMS REGARDING THE RATE, INCLUDES:
  • Unlimited mileage within Andalusia and the Valencian Community. Outside these regions +€150.
  • Fully comprehensive insurance with no excess
  • Deposit: €150
  • Young driver supplement (18–25 years old): €25.00 per day. Fully comprehensive insurance with €600 excess will apply and a €600 deposit must be left, which will be fully refunded upon return of the vehicle. In case of any damage, it will be deducted from the deposit.
  • Second additional driver at no extra cost.
EXTRA SERVICES
  • Baby seat free of charge.
PAYMENT CONDITIONS
  • VISA and MasterCard credit cards are accepted. Refunds must always be made using a credit card. If no credit card is available, cash payments are accepted.
GENERAL CONDITIONS
  • The rented vehicle is only authorised to circulate within the AUTONOMOUS COMMUNITY OF ANDALUSIA AND GIBRALTAR.
  • The insurance will be void if driving under the influence of alcohol, drugs or contraindicated medication, in which case all damages will be the responsibility of the renter.
  • Rental rates include compulsory car insurance coverage and complementary third-party liability insurance for damages caused during use and circulation of vehicles.
FUEL
  • The vehicle will be delivered with a full tank and must be returned with the same amount. If the vehicle is returned with less fuel, the difference will be deducted from the deposit.
  • These coverages are guaranteed by the insurer with whom the rental company has the corresponding insurance policy and are subject to the terms and conditions of that policy.
  • This policy does not cover damages, losses or any other harm to luggage, goods, or personal items transported in the vehicle, nor the total or partial loss of such items due to theft, vandalism or road accidents.
  • The Client undertakes to immediately inform the rental company of any incident or damage caused to the rented vehicle and to promptly forward any letters, summons or notifications related to said incident. The Client must fully cooperate with the rental company and insurance provider in investigating and defending any claim or legal proceedings. It is mandatory to present an accident or damage report within a maximum of 24 hours of the incident. In particular, in the event of an accident, the Client must:
  • Obtain full details of all persons involved in the accident, as well as any potential witnesses, a sketch of the accident, and the details of the other vehicle (registration, model, insurer, policy number, etc).
  • Immediately transmit the above information and further details of the accident to the Rental Company.
  • Immediately notify the authorities if the fault of the other party needs to be investigated or if there are injuries.
  • Not abandon the vehicle without taking the necessary measures to protect and safeguard it.
  • In case of fire, vandalism, theft or disappearance of the vehicle, the Client must immediately notify the rental company and file the corresponding police report.

  • Damage to the underbody of the vehicle, tyres and rims is not covered if caused by overloading, exceeding authorised limits in the Vehicle Registration Certificate and/or Technical Inspection Sheet, or by driving on unsuitable surfaces such as beaches, off-road tracks, forest paths or mountain roads not classified as authorised and paved roads.
  • Any damage to wheels, hubcaps, punctures, blowouts, interior of the vehicle, locks, undercarriage, clutch, engine sump, and radiator catalytic converter is also not covered. Battery charging costs for rims are always the renter’s responsibility.
  • The renter must refuel the vehicle with the appropriate fuel type. Otherwise, the renter is liable for the towing expenses and repair costs caused by the use of incorrect fuel.
  • The vehicle will be delivered with a full tank. The client must return the vehicle with a full tank as it was at the start of the rental period.
  • The renter agrees not to transport more passengers than the number of seats in the vehicle, nor to take part in races or competitions. Subletting or transporting people in exchange for payment is not permitted. The renter is solely responsible for any traffic fines or penalties and any consequences resulting from such infractions.
DRIVING LICENCE
  • You will need to present a valid driving licence, an identity document (ID or passport), and a credit card for the deposit.
  • The client must be the holder of the licence.
AGE LIMITS FOR RENTING A CAR
  • The driver must be at least 18 years old. To rent a van, the minimum age is 25 with a valid driving licence held for more than 4 years.
RETURNING THE VEHICLE
  • If the car is returned on a different date and time than stated in the contract, RENTYCAR will charge the applicable daily rate.
  • Transport costs, towing, tolls, custody
  • RENTYCAR reserves the right to take legal action with the competent authorities in any case of loss or non-return of the vehicle. The client assumes full responsibility for the consequences.
FINES
  • The client agrees and authorises RENTYCAR to process charges within one month after the end of the rental period via electronic payment systems or any other payment method.
  • The client consents in advance to the execution of such charges, which include:
  • All fines, both judicial and extrajudicial costs, resulting from improper parking, traffic violations, or breaches of driving regulations or any other type of fine issued against the vehicle, the client, or RENTYCAR during the rental period, unless attributable to RENTYCAR, will be paid by the client.
VEHICLE COLLECTION AND RETURN
  • Collection and return will take place at our Estepona office: Calle Ibiza 7 – local 1B – block 14.
  • Collection and return wil take place at our Valencia (Xàtiva) office: Calle Joan Fuster 1, 46819 Novetlè (Valencia)
CANCELLATION POLICY
  • To cancel and receive a refund of your deposit, contact us at least 48 hours before the start of your rental. Otherwise, the full booking amount will be forfeited.
CONTRACT EXTENSION
  • The client is obliged to return the car on the date and time indicated in the contract. If the client wishes to extend the rental, they must visit the RENTYCAR office in person to sign the extension. No extensions will be granted via telephone, email or text message.
  • If the contract cannot be extended due to vehicle unavailability or any other reason, the car must be returned on the originally agreed date and time.
  • When requesting an extension, RENTYCAR may require the client to sign a new contract, thereby terminating the previous one.
  • In all cases, the deposit may be used to cover the extension. Unilateral extension by the Client will be considered unauthorised use of the vehicle, with the same legal implications as failure to return it on time.
  • Any legal or extrajudicial expenses, including solicitor’s fees and court representation costs, arising from breach of this contract shall be borne by the renter. This contract takes effect on the date and time recorded on the check-out sheet and is signed in proof of agreement.
  • Any disputes shall be submitted to the jurisdiction of the courts of ESTEPONA.
  • The renter is responsible for returning the vehicle at the time, date, and place indicated in the contract. Failure to do so invalidates the insurance coverage and may constitute misappropriation as defined under Article 535 of the Spanish Penal Code.
DATA PROTECTION
  • In accordance with the General Data Protection Regulation (GDPR), we inform you that your personal data will be processed for administrative, accounting, operational, and tax purposes, as well as to send you commercial communications about our products and/or services. The data provided will be retained while the contractual/commercial relationship continues or for as long as necessary to comply with legal obligations. Data will not be shared with third parties except where legally required and will be processed based on your consent, contract execution or legal obligation.
  • You may exercise the following rights regarding your personal data: right of access, rectification, deletion (right to be forgotten), restriction, objection, portability, and to withdraw your consent. To do so, send an email to: INFO@RENTYCAR.ES
